APPENDIX 1 Flipbook website agreement

1. Wet Paper

Wet Paper is the trading name of The Moffatt Group Australia, a company registered in Australia under ACN 086 521 084. The Australian Business Number is ABN 61 086 521 084.
The Moffatt Group Australia registered office at 32 Michel Drive Currumbin, 4223.

2. Conditions of sales

Introduction

In these terms and conditions "we" and "us" mean The Moffatt Group Australia T/A Wet Paper or Wet Paper Publications, and "you" or "your" means you the customer.
These terms and conditions together with your orders for goods or services constitute the entire Contract between us and you for the supply of Services offered by Wet Paper. No other terms and conditions will apply. The Contract cannot be varied unless we agree to vary it in writing or by email.

These conditions set out your rights and obligations with respect to your purchases of goods and services

Goods are Wet Paper hard copy books and photocopied teacher resource materials.

Services include the supply of rental agreements to access digital files to our hard copy books. An example of our flipbook rental agreement is given in Appendix 1.

Goods are only sold within Australia however our web services are available worldwide.

Sales in Australian dollars

We only accept payment in Australian Dollars. Wet Paper purchases will include GST.

Ownership

Wet Paper retains ownership of all goods and services until paid for.

Applying for goods and services

Prices

Wet Paper endeavours to offer you good value for money. Our senior textbook is for two years and Junior Book for three. Both costs are significantly less than similar commercial school products. Wet Paper reserves the right to change prices for goods or services at any time.

Goods

You can purchase goods on line by using a shopping cart or by completing an order form and sending by fax, mail or as a scanned document to our email address.
As the print book industry is replaced by the digital age, we have no plans to reprint any of our books.

Conditions of sale of goods

The following is printed on our goods order form

All prices include gst. Prices valid to 30 MARCH each year. Prices, availability and freight costs are subject to change due to unforeseen circumstances. Instructor's guides and answer booklets only available from Wet Paper. Items indicated will be supplied.

Payment is to accompany order unless official school order used. Inspection copies for 7 days and must be returned in pristine condition (otherwise we cannot resell them).

Terms of trading are 14 days schools, 30 days booksellers. Discounts to schools are available on class set purchases of 15 or more. Postage is not subject to discount and can change in line with charges made by Australia Post. Faxed orders are firm sales.

If original order is sent in addition to the fax, it may be treated as a new order unless clearly marked - confirmation order. If this occurs, we reserve the right to charge full price for what appeared to be a second order.

Payment methods

Wet Paper allows you to purchase goods and services using any of the payment methods described below. Please carefully read our policies with respect to payment methods before you place your order.
If you do not wish to supply your credit card details, you can do so by fax or over the phone. However as we are a small business and are not always in the office we suggest you email us at info@wetpaper.com.au

Credit Card

When you apply online by credit card, Wet Paper will obtain a pre-approval from the card company.
Wet Paper accepts Visa or MasterCard with a billing address within Australia. If you wish to provide your credit card information by phone, please email us prior to make arrangements.
Debit cards and credit cards have daily spending limits that may substantially delay the processing of your order. You may also be required to provide further identification for additional security reference checks. You must pay the price in Australian dollars.

Paying online

Wet Paper would like to assure you that paying online with us is safe. We have taken every possible measure to give absolute security to our customers.

  • Our website uses the eMatters Payment Gateway for all online credit card transactions.
  • All transactions are performed under 128 Bit SSL Certificate. It is fully automated with an immediate response.
  • No human intervention is required to complete this credit card transaction. This is far safer than providing your credit card to a waiter or a retail sales person.

  • All transactions are performed under 128 Bit SSL Certificate.
  • eMatters has been approved by many global banks.
  • IP Global Positioning Fraud Management Software.
  • BIN checking, ensuring the cardholder is linked to the correct bank.
  • eMatters is authorized to connect to 7 Australian Banks, 4 New Zealand Banks, 1 Singapore Bank, 1 Malaysian Bank and 4 South African Banks. 17 Global banks in total.

  • Payments via credit card from our website are instantly processed.

Cheques

Wet Paper only accepts school cheques as valid forms of payment. If you wish to pay by cheque, the cheque must be payable to Wet Paper, and include your order number and/or a copy of your printed invoice from our web page. Please mail your payment to: Wet Paper, PO Box 540 Coolangatta 4225

Money orders and cash

Wet Paper does not accept cash or money orders. Customers without a cheque book or credit cards will need to go to their bank and arrange a direct deposit.

Direct deposit

Wet Paper accepts direct deposits as a valid form of payment. The following disclaimer applies to all our goods and services.

Although all care has been taken to provide information, safety instructions, offers of training and advice, Wet Paper or any of its advertisers, sponsors, employees, advisors or consultants accept no responsibility for any accident that may occur as a result of students performing any of these activities.

If students, teachers or instructors are unsure of any information or method, they are advised to contact their State Government Marine Safety Department. The publisher welcomes all comments for improvements.
Wet Paper is not responsible for typographic errors and reserves the right to change the terms and conditions of sale at any time.

3. Shipping

Goods

All goods are sent by Australia Post. Goods are supplied in boxes or envelopes with our invoice firmly attached in an "Invoice Enclosed" envelope on top of a box or envelope. Where more than one box is involved, the boxes are clearly identified as "box # of #".

From time to time, especially in larger orders involving goods supplied in a number of boxes, different boxes may arrive on different days, especially at the start of the school year when Queensland cyclones affect the delivery chain. Before we begin any tracking investigation, we ask customers to just wait a reasonable time until the roads reopen.

Services

The supply of Web services is instant if payment is made on line. If payment is to be made by cheque, credit card over the phone or by direct debit allow five working days after payment is received.

4. Refunds

If you are unhappy with any of our products or services we offer a full refund. Application can be made to info@wetpaper.com.au by using the word refund in the subject line.
Importantly, the rights described in this policy in respect of refunds are in addition to the statutory rights to which you may be entitled under the Australian Copyright Act 1966, Trade Practices Act 1974 and other applicable Australian consumer protection laws and regulations.

5. Privacy policy

Introduction

The Wet Paper privacy policy adopts the National Privacy Principles contained in the Privacy Amendment (Private Sector) Act 2000.

Why Wet Paper collects information

Wet Paper collects and stores personal information which is necessary to administer our electronic book services. These services includes the provision of

flipbooks books that enable the customer to read our publications on-line news, notification of conferences/workshops and resource updates for teachers

Confidentiality

Personal information is strictly confidential and is not made available to anyone other than the classroom teacher to which the students are registered and Wet Paper office staff.

Access by customers

Members have the right to request access to their personal information and are able to view it on our web site. This right is subject to some exceptions which are set out in the Privacy Amendment (Private Sector) Act 2000. In order to ensure the privacy and security of its members and other associates, Wet Paper requires any request for information to be made in writing including full name, address and phone number. This way staff can speedily verify authenticity of the request.

Use of cookies

Wet Paper may from time to time use imbedded images, files or cookies to help manage and track our electronic advertising (including Online, Email and SMS). From time to time and in line with customer expectations and legislative changes, our privacy policies and procedures will be reviewed and, if appropriate, updated.

6. Use of our web site

Introduction

These Terms and Conditions ("Terms") apply to the Wet Paper Website. They apply regardless of the means of delivery of our Website to you. If you do not accept these Terms, do not use our website. We may change these Terms from time to time, so you should review them each time that you visit our website. You should print a copy of these Terms for future reference.

Using flipbooks on our web site

If you are under 18, you must first obtain the consent of your parent or guardian to use or register with our website. This is done through your school internet policy. If none exists, do not use our Website.


You may view (and, where applicable, listen to, if applicable) the content available on our Website for education purposes only. Any commercial use of our website is strictly forbidden and these Terms and Conditions shall be construed accordingly.

Content available on our website is made available in individual products.

Each time you buy a product, you agree to access the product under the Flipbook Website agreement as detailed in Appendix 1. All other products are subject to the copyright notice as specified in Appendix 1.

Linking to our web site

You may establish a link to our website, provided that:

• the link is on a website owned by you;
• the link is not detrimental to and/or does not take unfair advantage of our reputation or business;
• the link does not falsely suggest that we endorse, approve of or are associated with your website or any of its contents; and
• framing is not allowed and you must not provide access to our website or part of it under any other URL (e.g. by domain forwarding, URL re-direction or similar).
• Other than that, linking to our website is not allowed.

Registration

Only one registration per person is allowed. You must keep your registration information up to date.

You must choose a personal email address which gives you frequent access to emails sent to that address, as we need to be able to contact you. You must keep your password confidential.

You must not:

• impersonate or try to impersonate another person;

• disclose your password to anyone else;

• allow anyone else use to your account;

• use anyone else's account.

We may suspend, terminate or prevent your registration at our sole discretion. This may be because, for example, we consider that you have breached or will breach these Terms or our Community Guidelines or someone has reported abuse. However, we are not obliged to do these things. It is our policy to terminate the registration of anyone who repeatedly infringes the rights of any third party.
Where we suspend, terminate or prevent your registration, you must not attempt to re-register (e.g. using someone else's registration), without our permission. The period of any suspension depends on all the circumstances.

Where our website contains links to other sites and resources, which are provided by third parties, these links and resources are provided for your information only and you access them at your own risk. Flipbook website agreement

Definitions and ordering details

Flipbook

This is a Wet Paper Publication that has been converted to an electronic format designed to be read on most electronic devices including phones, laptops and tablets capable of internet reception.
The flipbook is opened with a publication key and read by these electronic devices from the Wet Paper web site. The flipbook cannot be read if the electronic device is not connected to the internet
Wet Paper cannot guarantee that the book can be read on all devices. If the flipbook does not open, the school will receive a full refund and the key cancelled at no charge.

Types of flipbook

Read only and printable flipbooks are available for sale for this web site.
Read only flipbooks are accessed by teachers and students and expire after 12 months
Printable flipbooks are accessed by ONE user, are subject to copyright, and can be printed to a photocopier or "to file" as a Adobe Acrobat pdf document

Purchasing flipbooks

Flipbooks are ordered on line, from a cart once a customer sets up an account.
As soon as credit card is approved for payment, Wet Paper issues a publication key/s for the flipbooks purchased.
The teacher needs to activate this/these key/s via their account BEFORE distributing the key/s to their students.

Students then set up an account with Wet Paper and use this/these key/s to open the flipbook/s for the school year

Trading name

Wet Paper is the trading name for The Moffatt Group Australia (ACN 086521084) and is a Queensland based book publishing company established in 1987 by Bob and Paula Moffatt
It specializes in books for primary and secondary schools in marine studies and marine science.
• Their books are listed at www.wetpaper.com.au and before retirement they wish to publish their books on line so schools can continue to use them in their marine courses.

• Wet Paper is responsible for the administration of its flipbooks.
• The school is responsible for managing the students computers, I pads and tablets internet connection

Rental agreement

The school agrees to

Authorise their teachers and students to create an account with Wet Paper

Pay Wet Paper so the book can be unlocked for the school's classes

Manage all computer issues with the students

Abide by the conditions of sale, shipping, refunds, privacy and use of our web site policies including copyright as outlined on this web site

Wet Paper agrees to

Refund your payment within 30 days if the flipbook format does not work.
Supply coded information in a single publication key that the teacher can use to allow students and teachers to use the electronic flipbook

Register the school and its teachers in the Wet Paper system
