1. Introduction

1.1 The following terms and conditions, now referred to as "Terms", set out your rights and obligations with respect to your purchases of goods and services from our business.

In these Terms, "we" and "us" mean The Moffatt Group Australia T/A Wet Paper or Wet Paper Publications, "you" or "your" means you, the customer and "our website" refers to the URL http//:www.wetpaper.com.au.

Our Ebooks are called Flipbooks.

Under these Terms, the person who first registers a publication key for a Flipbook is called the initial account holder and becomes the only person we communicate with regarding these books.

These Terms together with your orders for goods or services constitute an entire contract between you and us for the supply of goods or services offered by us. No other Terms will apply.

The contract cannot be varied unless we agree to vary it in writing or by email.

1.2 We are registered as a company under the name of The Moffatt Group Australia, ACN 086 521 084, with a registered office at 32 Michel Drive, Currumbin, 4223.

We trade under the name Wet Paper with ABN 61 086 521 084, and postal address at PO Box 540, Coolangatta, 4225.

1.3 The home/products tab at the top of our website details hard copy and electronic books for sale. The "about us" section on our website, describes the type of consultancy services we offer.

Please note that prices, availability, consultancy services and freight costs are subject to change.

Hard copy printed and bound books, are only available for sale in Australia. Customers are advised to check our web site for stock levels and availability.

These books are sent by Australia Post in boxes or envelopes with our invoice firmly attached in an "Invoice Enclosed" envelope on top of a box or envelope.

Where more than one box is involved, they are clearly identified as "box # of #". From time to time, different boxes may arrive on different days, especially when Queensland cyclones affect the delivery chain. Before we begin any tracking investigation, we ask customers to just wait a reasonable time until delivery services reopen.

Electronic books are called flipbooks that are rented for 14 months from our website.

2. Payment methods

2.1 We accept Visa or MasterCard. You must pay the price in Australian dollars. All purchases include GST.
A nominal charge is made for postage on hard copy books and is shown on the shopping cart prior to payment. We do not apply credit card surcharges.

2.2 We would like to assure you that paying online with us is safe and have taken every possible measure to give absolute security to our customers.
Our website uses the Eway payment gateway for all online credit card transactions. All transactions are performed under 128 Bit SSL Certificate, which is fully automated with an immediate response.
No human intervention is required to complete this credit card transaction. This is far safer than providing your credit card to a waiter or a retail sales person. 


2.3 All checkouts with Flipbooks require you to set up an account. Checkout with hardcopy books has the option to pay without setting up an account.

2.4 We do not accept cheques, cash or money orders. Customers without a cheque book or credit card will need to go to their bank and arrange a electronic funds transfer (EFT).

2.5 Our tax invoices show amount owing, amount paid and the GST component of the sale. We do not issue receipts.

2.6 If books are missing pages, we will replace the books at our expense provided we receive information stating the missing page numbers so we can go and check our batch numbers.
Importantly, the rights described in this policy in respect of refunds are in addition to the statutory rights to which you may be entitled under the Australian Copyright Act 1966, Trade Practices Act 1974 and other applicable Australian consumer protection laws and regulations.

3. Product liability and indemnity

3.1 Although all care has been taken to provide information, safety instructions, offers of training and advice, Wet Paper or any of its advertisers, sponsors, employees, advisors or consultants accept no responsibility for any accident that may occur as a result of students performing any of activities described in our books.

If students, teachers or instructors are unsure of any information or method, they are advised to contact their State Government Education or Maritime Safety Department as well as consulting with material safety sheets and procedures relevant to the materials and procedures as outlined in the activities.

This is particularity important in our practical marine education workbooks, as government policy and procedures change on a regular basis specifically with respect to the use of life saving equipment and first aid procedures. It is highly recommended that all users of these publications keep a yearly update in first aid training and read government websites regarding changes to regulations.

3.2 We reserve the right to change these Terms at any time. We always welcome your comments for improvements and correct known errors in future editions.

4. Copyright

4.1 It is a condition of sale that you abide by the following copyright statement for all our publications.

"Except as permitted by the Copyright Act 1968 (Cth), you may not reproduce any of the contents of this publication, without the written permission of the copyright owner.

There is however the following educational exemption in Part VB of the Copyright Act 1968 (Cth), where you are entitled to reproduce or communicate 10% of the words or one chapter for educational use within your school.

4.2 If you wish to reproduce or communicate MORE than 10% please contact us at info@wetpaper.com.au to gain written permission.

5. Privacy policy

5.1 Our privacy policy adopts the National Privacy Principles contained in the Privacy Amendment (Private Sector) Act 2000.

5.2 We collect and store personal information, which is necessary to administer our electronic book services. These services include the provision of flipbooks that enable you to track key registration and use, read our on-line news, notification of conferences/workshops and resource updates for teachers.

5.3 Personal information is strictly confidential and is not made available to anyone other than the classroom teacher to which the students are registered, and, our office staff.

5.4 You have the right to request access to your personal information and are able to view it on our web site. This right is subject to some exceptions, which are set out in the Privacy Amendment (Private Sector) Act 2000. In order to ensure the privacy and security of you and other associates, we require any request for information to be made in writing including full name, email address and phone number.

5.5 We use cookies to allow our website to work. From time to time and in line with customer expectations and legislative changes, our privacy policies and procedures will be reviewed and, if appropriate, updated.
If cookies are removed, our Flipbooks will not work.

6. Use of our web site

6.1 These Terms apply to our website. If you do not accept these Terms, do not use our website. We may change these Terms from time to time, so you should review them each time that you visit our website. You could print a copy of these Terms for future reference.

6.2 If you are under 18, you must first obtain the consent of your parent or guardian to use or register with our website. This is done through your school internet use policy. If none exists, do not use our Website. 

You may view (and, where applicable, listen to, if applicable) the content available on our Website for education purposes only. Any commercial use of our website is strictly forbidden.

6.3 You may establish a link to our website, provided that the link is on a website owned by you; the link is not detrimental to and/or does not take unfair advantage of our reputation or business; the link does not falsely suggest that we endorse, approve of or are associated with your website or any of its contents and framing is not allowed.
You must not provide access to our website or part of it under any other URL (e.g. by domain forwarding, URL re-direction or similar). Other than that, linking to our website is not allowed.

6.4 We are not responsible if you cannot access our website properly or at all or if some of its features are unavailable to you because of any event outside our control, for example the performance of your or our ISP, your browser or the Internet or limitations in the capability of your accessing device.

6.5 Only one registration per person is allowed. You must keep your registration information up to date.

You must choose a personal email address, which gives you frequent access to emails sent to that address, as we need to be able to contact you. You must keep your password confidential.

You must not impersonate or try to impersonate another person; 
disclose your password to anyone else; 
 allow anyone else use to your account or use anyone else's account.

If you think that someone else may have access to, or be using, your password or account, you must tell us as soon as possible by emailing info@wetpaper.com.au.

6.6 We may suspend, terminate or prevent your registration at our sole discretion. This may be because, for example, we consider that you have breached or will breach these Terms or someone has reported abuse. However, we are not obliged to do these things.

It is our policy to terminate the registration of anyone who repeatedly infringes the rights of any third party.

Where we suspend, terminate or prevent your registration, you must not attempt to re-register (e.g. using someone else's registration), without our permission. The period of any suspension depends on all the circumstances.

7. Use of Flipbooks (electronic publications)

7.1 Flipbooks are formatted as "read only" or "printable" and are rented for 14 months on computers, smart phones, tablets or laptops provided a reliable internet connection is available.

Flipbooks are activated in an account with a publication key. The person who first registers that key is the initial account holder.

The school is responsible for ALL other computer issues.

The 14 month activation period begins when the initial account holder registers the key.

Expiry notice emails are sent out one month, one week and one day prior to expiry. If a renewal payment is not received, they are removed from your account.

Our policy is that you use your school credit card to buy flipbooks from our website.

After payment is made we will send you an email with a publication key and registration instructions. This email will also contain a paid tax invoice.

Finally, if our Flipbooks don't work, we will refund your money.

7.2 Our read only Flipbooks are sold in sets of 30. The initial account holder registers the key and then allocates that key to 29 users.

The 29 users individually set up accounts whose emails are linked to the initial account holder's email.

This allows the initial account holder to monitor key use. If further users are required, the initial account holder can add users.

Users of read only flipbooks are only allowed to turn pages, search for words or phrases, create bookmarks and use a table of contents. No other use is permitted unless exempt under copyright legislation.

7.3 Printable flipbooks have been designed to be used by the initial account holder as they contain student answers and worksheets.

There is a warning on our website that says we monitor the sales of these books, but there is no guarantee students will not buy these books. The only answers we sell are to textbook or worksheet questions. We do not supply answers to our exam question booklet.

After payment, and the key has been registered by the initial account holder, the book can be opened.

To print the book, you select the print icon and follow the instructions on our web site.

You can also copy text into word processing programs or place the file on your school intranet.

After 14 months the initial account holder will get an email asking if the school wishes to continue the rental agreement. If you do not wish to renew the rental period, we require you to stop using the files.

7.5 Under no circumstances is the school to provide or on-sell either the Master or any reproductions of the Wet Paper resources to any third party. For example if a teacher transfers to anther school, the new school has to rent a book for their school.
